For example, most lawyers refuse to take an employee’s case before an adverse action has been committed (i.e. firing, suspension, or discipline). At Filippatos PLLC, we will take a case even if the employee merely suspects they may experience unlawful conduct (discrimination, retaliation, or harassment) in the future. These are called Fact in Development (FID) cases, wherein we work with our client to understand what the potential conflicts and power dynamics are, and help them to create the necessary record to later effectuate their claims if treated unlawfully by their employers. We help them curate the facts to strengthen their potential claims and engage in various forms of counseling and coaching to help them protect themselves from unlawful treatment in the workplace.
